1. Scope of Agreement

These Terms & Conditions apply to all agreements concerning wedding photography, filmmaking, albums, and related services provided by Stillwater Stories.

The individual agreement, accepted quotation, and these Terms & Conditions together constitute the agreement between Stillwater Stories and the Client.

In the event of any inconsistency, the individual agreement and any separately agreed written terms shall take precedence.

Nothing in these Terms & Conditions limits the Client's mandatory rights under Danish law.

2. Booking and Payment

A booking becomes binding once the Client has accepted the agreement in writing and Stillwater Stories has confirmed the booking.

The following booking payments apply:

50% of the total agreed price when Nikola Majkic is personally booked to provide photography or filmmaking services.
25% of the total agreed price when the services are provided by other members of the Stillwater Stories team without Nikola Majkic.

The booking payment is due as stated on the invoice.

The remaining balance is normally invoiced after the wedding and must be paid before the final material is delivered.

Invoices are generally payable within eight days unless otherwise agreed.

Interest and fees for late payment may be charged in accordance with applicable law.

3. Cancellation by the Client

If the Client cancels the wedding booking, the booking payment is generally non-refundable, regardless of when the cancellation takes place.

The Client will not be required to pay the remaining balance following cancellation, even if the cancellation takes place shortly before the wedding.

Any separately agreed third-party expenses will be handled in accordance with the relevant written agreement.

Any applicable statutory right of withdrawal and other mandatory consumer rights remain unaffected.

4. Rescheduling the Wedding

The Client may request to move the wedding to an available date in the following calendar year.

For example, a wedding originally scheduled for 2027 may be moved to an available date in 2028.

Rescheduling is subject to the availability of the originally booked photographer or agreed team and must be confirmed in writing by Stillwater Stories.

When rescheduling is approved, the original agreement continues under the same terms, and the booking payment is transferred to the new date.

If the requested date is unavailable, or the wedding is moved beyond the following calendar year, the change will be treated as a cancellation unless otherwise agreed in writing.

Any further request to reschedule will be considered individually. Stillwater Stories may offer a new agreement with revised pricing or services, which will only apply if accepted in writing by both parties.

5. Changes to the Booked Collection

The agreed collection is binding on both parties.

The Client may not unilaterally reduce the photography coverage, remove filmmaking services, or exclude other booked services.

Any changes require a new written agreement.

Additional services may be added by mutual agreement, subject to availability.

6. Photography, Filmmaking and Artistic Approach

Stillwater Stories works with a natural, documentary approach to photography and filmmaking.

The Client acknowledges familiarity with the Stillwater Stories portfolio and accepts that image selection, editing, colour grading, and filmmaking are carried out according to the professional and artistic judgement of Stillwater Stories.

Stillwater Stories aims to document the important moments of the wedding but cannot guarantee specific individual photographs or footage unless separately agreed.

RAW files and unedited material are not included unless expressly agreed in writing.

7. Copyright and Personal Usage Rights

Stillwater Stories retains the copyright to all photographs and films created under the agreement.

The Client receives a personal, perpetual, non-exclusive licence to use the final delivered material for private, non-commercial purposes.

This includes downloading, storing, printing, sharing with family and friends, and posting the material on the Client's personal social media accounts, subject to any applicable rights restrictions.

Without prior written permission from Stillwater Stories, the Client may not:

Sell, sublicense, or commercially exploit the material.
Re-edit, manipulate, recolour, or apply filters to the delivered photographs or films.
Recut or otherwise modify the wedding film, including replacing its music.
Supply the material to wedding suppliers, businesses, or media outlets for their publication or marketing.
Authorise third parties to use the material commercially.

Ordinary technical adjustments, such as necessary cropping for social media, are permitted provided they do not materially alter the intended appearance.

Wedding suppliers, businesses, and media outlets wishing to use the material must obtain permission directly from Stillwater Stories.

8. Music in Wedding Films

Stillwater Stories uses music in wedding films within the rights applicable to the agreed use.

The Client may share the completed film privately and on social media to the extent permitted by the relevant music rights.

The Client may not change the film's music or editing without written permission.

Stillwater Stories is not responsible for copyright infringements arising from subsequent unauthorised modifications or uses outside the agreed scope.

9. Payment and Final Delivery

The remaining balance must be paid before the final material is released.

Stillwater Stories may withhold final delivery until overdue payment has been received, to the extent permitted by law.

Any photographs or films already delivered as a preview may continue to be used by the Client in accordance with the agreed personal usage licence.

10. Other Suppliers and Wedding Guests

Stillwater Stories is not responsible for missing or compromised photographs or footage directly caused by circumstances beyond its reasonable control.

Examples include guests, other photographers, videographers, content creators, or suppliers obstructing the view, changing lighting conditions, or interfering with the work.

Stillwater Stories will make reasonable efforts to find an alternative solution where possible.

This provision does not exclude liability for Stillwater Stories' own errors or negligence.

11. Schedule, Locations and Working Conditions

The Client must inform Stillwater Stories of significant changes to the wedding schedule, locations, and other practical arrangements.

The Client is responsible for obtaining any necessary permissions for photography and filming at the selected locations unless otherwise agreed.

Stillwater Stories is not responsible for restrictions imposed by churches or venues, access limitations, weather conditions, or significant delays beyond its control where these could not reasonably have been avoided or remedied.

Stillwater Stories may suspend work in the event of serious safety concerns, including threats or violence.

For bookings exceeding six consecutive hours, the Client must provide a suitable meal and drinks for the booked team.

12. Additional Hours, Travel and Accommodation

Additional photography or filmmaking hours must be agreed separately and will be charged at the agreed rate.

Travel expenses and any accommodation arrangements will be specified in the individual quotation or agreement.

Additional expenses not included in the agreement require the Client's prior approval.

13. Illness or Unavailability

If the booked photographer or an essential member of the filmmaking team is unable to attend, Stillwater Stories will make reasonable efforts to arrange a qualified replacement.

If Nikola Majkic has been personally booked, any replacement photographer requires the Client's approval.

If the agreed services cannot be provided, payment for the undelivered portion will be refunded.

Any additional remedies will be determined in accordance with applicable Danish law.

14. Technical Issues and Data Loss

Stillwater Stories uses professional equipment and takes reasonable precautions to protect recordings and digital files.

Unforeseen technical issues or circumstances during the wedding may affect the material.

Stillwater Stories is not responsible for missing or compromised material caused by circumstances beyond its reasonable control that could not reasonably have been anticipated, avoided, or remedied.

Any technical failure or loss of material will be assessed individually.

Where part of the agreed delivery is missing, Stillwater Stories will make reasonable efforts to remedy the issue or find an appropriate solution.

Any entitlement to a price reduction, refund, or compensation will be determined under applicable Danish law.

15. Delivery and Storage

Expected delivery times are stated in the individual agreement or quotation.

Stillwater Stories retains the final edited digital photographs and films for at least 12 months following delivery.

After this 12-month period, Stillwater Stories is under no contractual obligation to continue storing the material or to provide it again.

Stillwater Stories may choose to retain a backup for longer as an additional service, allowing it to assist Clients who later lose their photographs or films where possible.

This additional backup service does not constitute a guarantee of permanent storage or future redelivery.

The Client is responsible for downloading and maintaining independent backups of the delivered material.

Stillwater Stories does not guarantee the retention of RAW files or other unedited material following final delivery.

The Client's mandatory rights concerning any defects remain unaffected.

16. Albums and Physical Products

Where an album is included in the agreed collection or purchased separately, the Client is entitled to receive it once the necessary photographs have been selected and the design has been approved.

There is no fixed deadline for selecting photographs for a paid album.

Stillwater Stories selects the professional manufacturers used for albums and prints unless otherwise agreed.

If a particular material, cover, or product is discontinued, Stillwater Stories will offer a comparable alternative of equivalent quality and value.

If a comparable alternative cannot be supplied, another appropriate solution will be agreed in accordance with applicable law.

A paid album does not expire simply because the Client takes a long time to select photographs.

Production begins once the necessary selections and album design have been approved.

The Client's statutory rights concerning defects remain unaffected.

17. Portfolio and Marketing

Stillwater Stories may use selected photographs and films in its portfolio and marketing where a valid legal basis exists.

The Couple may voluntarily provide separate consent for the use of identifiable photographs and films featuring them in Stillwater Stories' marketing.

Sharing identifiable photographs of the Couple with other wedding suppliers for those suppliers' marketing requires separate permission and a valid legal basis.

The Couple cannot consent on behalf of other adult wedding guests.

Publication of photographs featuring identifiable guests is assessed separately under applicable data protection law.

18. Personal Data

Stillwater Stories processes personal data in connection with enquiries, bookings, photography, filmmaking, delivery, and possible marketing.

The Client is encouraged to inform wedding guests that photography and filming will take place.

Guests may contact Stillwater Stories regarding particular wishes concerning photography or publication.

19. Statutory Right of Withdrawal

For distance contracts and contracts concluded away from business premises, the rules on withdrawal under the Danish Consumer Contracts Act apply where the particular agreement falls within their scope.

Certain services provided on a specified date may be exempt from the statutory right of withdrawal.

Where the Client has a statutory right of withdrawal, that right applies regardless of the provisions concerning the booking payment.

Any legally required information about withdrawal rights is provided separately during the booking process.

20. Force Majeure

If extraordinary circumstances beyond either party's control make performance of the agreement impossible, the affected party must notify the other as soon as reasonably possible.

The parties will first seek a reasonable solution.

If the agreement cannot be performed, the financial consequences will be determined under the agreement and applicable Danish law.

21. Complaints and Liability

If the Client believes that the delivered services or products are defective, Stillwater Stories should be contacted within a reasonable time after the issue is discovered.

Stillwater Stories must be given an opportunity to investigate the issue and, where appropriate, offer a solution.

The Client's mandatory statutory rights remain unaffected.

22. Governing Law and Disputes

The agreement is governed by Danish law.

Any disagreement should first be addressed through direct dialogue.

If no resolution can be reached, the matter may be brought before the competent courts or relevant consumer complaint bodies in accordance with applicable law.
